Veritas International Nominees and Trustees Friday Read CONCEPT OF ENFORCEABILITY OF ILLEGAL CONTRACTS

CONCEPT OF ENFORCEABILITY OF ILLEGAL CONTRACTS

Welcome to this Friday’s read, where we uncover the hidden traps of contract enforceability in Ghana. You may have a contract that looks like a masterpiece, but the courts may still reject it if it’s considered illegal. Illegality in this case refers to contracts that go against statutes or public policy.
Think of it as the law giving certain types of contracts the cold shoulder for reasons of public policy or unlawfulness. So, even if a contract has all its duck in a row, the courts may still send it packing.
To give you a taste of what is on the menu, contracts that involve committing a crime, fraud, or tort on another party, promoting sexual immorality, deceiving public authorities, or using official positions for personal gain are all considered illegal and unenforceable. And any agreement that tries to enforce such contracts will also be sent packing.
So, before you sign on the dotted line, make sure you are not signing up for a legal nightmare. Share with your network and stay informed! #contractlaw #Ghana #legalawareness.
